AB The Directive 2008/52/ EC of the European Parliament and of the Council of 21 May2008 opened the door to the possibility of establishing mandatory mediation for certainmatters. There are many jurists and mediators who have spoken on this issue, mainlygenerating two sides, one of those who are in favor of implementing mandatory mediationand another, formed by those who believe that this proposal breaks completely witheverything the mediation process means. The present research seeks to organize an 3important part of the information that has been generated over the years in relation withthis subject, collecting both arguments, the ones that are in favor and those that arepositioned against, in order to generate a document which groups both points of view andgive him my personal vision about his posible future implementation.
