AB One of the biggest challenges that the advancement of new technologiespresents is the solution of the problems that arise after people pass away withtheir identity, goods and rights of the digital environment.Some service providers, through their use policies, have begun to respond tothe concerns of their users, however, the solutions offered are diverse and,often, unknown.To prevent that information and contents hosted in third-party servers be attheir own disposal, in recent years some legislative initiatives haveproliferated to respond to the main problem: the impossibility of the heirs ofapprehend the goods transmitted by the inheritance.In addition, it is relevant that some aspects of the digital environment relatedto the personality of the individual -digital identity, integrated into thedefuncti memory-, are perpetuated with technological advances, whichrequires a specific response from legal system.The main objective of this paper is to highlight the challenges and difficultiesthat arising from the application of the inheritance law in relation to thegrowing number of goods and rights of the digital environment.
