Dos derechos separados por la Constitución española y unidos por la doctrina A1 Doro García, Cristina A2 Grado En Derecho K1 artículo 17 de la Constitución española K1 derecho a la libertad personal K1 derecho a la seguridad personal K1 article 17 of the spanish Constitution K1 right to personal liberty K1 right to personal security AB The conceptualization of the right to freedom and security has been a neuralgic point ofphilosophical thought from its origins, forming innumerable theories not only about thenotion of each of these rights, but also regarding the establishment of the necessarylimitations for its effectiveness, acting in many cases the right to freedom as a limitationof the right to security and vice versa.The Spanish legal system recognizes both the right to freedom and the right to securityin Article 17 of the Spanish Constitution, but, this wording leaves a wide margin for thetheoretical conception of each, continuing with the debate, now settled by the doctrineand the jurisprudence, which, in addition, deploys an important relevance in theapplication and in the establishment of the scope of both rights, both in the spatial andpersonal sphere.However, the fundamental right nature and the wide range of protections attributed byits wording in Title I, Chapter II, Section I of the Spanish Constitution should not implyits unlimited use, insofar as it would constitute an abuse of right, as well as implyingignorance of the principle of legal unity, which imposes the constant presence of allrights at any time.
