AB The so-called higher interest of the child is presented as an indeterminate legalconcept whose lack of determination makes it the legislator who, under adiscretionary judgment, makes the decisions. As far as the placement isconcerned, the best interests of the minor are exhibited as the basis by which theminor must be produced, it must be ensured that when a minor is declared indistress and placed in the hands of the public administration, the motivation bywhich decisions must be made must always be the achievement of the bestinterests of the child. In spite of this, we must not forget that sometimes it isdifficult to pretend to legislate when there are no specific premises that definewhat is intended to be defended. This is the difficult task that the legislator hasespecially in the issue that is going to be treated,because there are as many casesas decisions can be made and it is a fundamental task that there is a symmetrybetween the resolution that is adopted and what really child needs.
