AB The present work addresses the legal foundations of sentence no. 459/2019 of the Tribunal Supremo known as “The Procés” case, regarding the independence push in Catalonia that has been in the media in recent years. In particular, the proven facts of the aforementioned judgment are analyzed, as well as the legal foundations that the Second Chamber of the Supreme Court used to convict the accused of the criminal figures that were charged, in particular, the crime of rebellion, sedition, embezzlement of public funds, civil disobedience and membership in a criminal organization.All this is done in order to delve into a relevant process at the legal and social level of the Spanish State, with the objective of this analysis, the exposition of a descriptive and critical vision, in the technical-legal aspects that proceed.
