AB In this master´s thesis we are going to carry out an analysis about the right ofuse the family dwelling regarding his attribution after the marriage breakdown,studying how it is perfected in the exclusive guard and custody system and inthe shared custody. Also, we are going to pay attention to the judicial sentenceof the Supreme Court number 641/2018, of November 20, 2018 because for thefirst time is established a transcendent jurisprudential doctrine in relation to theextinction of the right of use. The importance is focuses on the argumentationthat the entry of the new couple of the custodian progenitor into the familydwelling is a cause of extinction of the right of use the family home that hadbeen attributed to the children and that parent in the judicial sentence.
