AB This work involves emphasize the importance of the existence of a previousphase to the bankruptcy procedure which is intended to offer an additionalopportunity to the debtor to solve their situation without having to submit tothe bankruptcy rules. And this idea is defended in order to improve this phasewhile remaining aware of the regulatory instability present in our law system,which is the result of constant improvement attempts by the legislator,possibly without having achieved the intended results.In this case, it´s necessary emphasize a pre-bankruptcy mechanism such as"fresh money” and setting the purpose of getting that the legislator to give aregime with better privileges that encourage its use in the context of the nearinsolvency.
