AB In Spain, the Criminal Responsibility of Legal Persons is first established in LO5/2010, a fact that generated numerous disputes between doctrine andjurisprudence, especially as regards the model of attribution of thatresponsibility. Five years later, following the adoption of the current LO5/2015, the legislature puts in its Preamble, points on this issue, in order toclarify this controversy.However, given the limited regulation on the subject, it is the Courts that havebeen creating criteria to try to preserve a balance in this attribution model.Thus, the judgment of the Plenary of the Supreme Court 154/2016 of 29February is of vital importance, the latter being the first judicial decision whichrefers to the criminal liability of legal persons, and that it has assumed that thecase-law maintains the criterion laid down in that STS.In turn, an extensive doctrinal debate has been generated, the purpose of whichhas been to clarify what the model of attribution of responsibility to which ourPenal Code has received
