Two legislative initiativesare attempting, leading by hand, to guide a reform of the Criminal Code in order toadapt it to the Istanbul Convention, the aim of which is to give that importance toconsent. There are different ways of granting consent, as, in this type of personalrelationship, a document will rarely be signed to allow intimate behaviour toproceed. Even so, circumstances may arise in the victim that vitiate or invalidateher consent, so it is very important to take them into account; the same happens tothe consent given by a minor under 16 years old to an adult, it is invalid (there is anexception to this general rule of invalidity). It is a good idea to look back at theunjust regulation on abuse in the couple a few years ago, which is totally differentfrom the current one, since the crime is considered to have been committed in thesame way outside or inside the relationship, without this being a possibleextenuating circumstance. Without leaving aside, finally, the question of thesubjects that take part in the crime and their possible individual or collective action,differentiating the consequences of the possible actions.
