AB This Project has as object the legal analysis of regulation of the internationalemployment contract, characterized by its relation to more than one legal system,because of the presence of one or more foreign elements (the nationality of any of theparts to the contract, either employer or worker or both, and/or a foreign country as aplace of provision of worker services).The rules of Private International Law are those that carry out this specific anddifferentiated regulation with respect to the employment contracts entirely linked Spanishlaw. It is a branch of the Spanish legal system which object includes these privateinternational situations of labor nature and its rules will determine whether or not theSpanish courts have International Judicial Competence to know the matters that arebrought before them and, if so, the applicable law given by the Spanish judge to resolveit, be it Spanish labor law itself or a foreign one.The rules that regulate these issues are “Europeanized” and, both the one relatedto International Judicial Competence (Brussels I Bis Regulation), and the one in chargeof stating the applicable law to the international employment contract (Regulate Rome I),these count with numerous decrees in which protection towards the most vulnerable partof the employment contract, the worker, is notable, and that will be analyzed in detail,unlike the general regulation of international contracts that start from a position ofabsolute equality of the parts.
