AB The crime against occupational safety and health is the only crimeagainst the rights of workers that the imprudent form admits sincearticle 317 of the CP refers to the previous article, that is, to article 316of the CP.In this work we will study the fundamental aspects of crimes againstoccupational safety and hygiene, their regulation and legal nature, aswell as the analysis of the requirements of the criminal type, makingspecial reference to the concept of "not providing the necessary means". Likewise, we will study the distinction between intentional commissionand reckless commission in crimes against safety and hygiene at work,with special reference to the reckless commission modality of article317 of the CP. Finally, we will study “serious” recklessness as arequirement of the objective type of article 317 of the CP.
