AB This paper focuses on the analysis of the assets that make up the Spanish culturalheritage. Cultural heritage is made up of movable and immovable cultural property, theformer being those that are mostly subjected to cultural traffic. The transfer of heritagebetween territories may fail to comply with the requirements established for itstransmission to be lawful, for which, sanctions and recovery mechanisms are providedfor by the different states. Spain has its own tools for returning the property to its state oforigin, whether it belongs to the Spanish state itself or another, and also, at European andextra-European level, various ways are established to “return” the assets that comprisethe cultural heritage of a country. However, the only obligation on the state level does notend with the defense of the cultural heritage, but expands to a duty to ensure access toculture, while the Autonomous Communities will also have competence to develop otheraspects of the Spanish historical heritage.
