AB This study focuses on the use of the contract and in some cases thesubcontracting as an option, which have the companies to outsourcing theiractivity at a national level. To that end, first of all, it explains whatoutsourcing is, understanding it as a tool to get a higher businessproductivity and the legal basis which validate it. After that, it defines thesubject matter (contact and subcontracting) for a better understanding of theresponsibilities system which results from it.Likewise, it explains concepts such as “own activity” for a betterunderstanding of the responsibilities system suitable in each case in termsof social security contributions, prevention of occupational risks andsalaries inter alia. Finally, it focuses on the illegal worker´s transfer whichtake place when occurs an illegal action of the analysed concepts.
