AB Along the way, we will analyze the treatment of disabled and persons whosecapacity to act has been amended judicially by judgment, in order to be able toexercise a right as personal as the right to dispose of their property mortis causa.To this end, we will study the work to be done by the public federated in orderto provide the legal certainty required by a legal business such as the will, on thebasis of the capacity required for this purpose under the provisions of thelegislator, both state and foral. In addition, judgments of incapacitation which arepronounced or not on the ability to test the incapable will be examined, for whichdifferent decisions of our Provincial Hearings and, of course, the High Court willbe taken as a starting point. Finally, we will refer to the possibility of challengingthe will for lack of capacity in the testator and the possible liability arising fromthe notary’s action before the challenge and nullity of the will.
