AB This research work is about the study of crimes against sexual freedom, ormore specifically, about the different commissive means criminalized byour Penal Code, with the intention of clearly outlining the typical elementsand the requirements usually demanded by the doctrine and thejurisprudence, therefore, of the use of each commissive means derives theapplication of two different punitive regimes, which means classifying thecriminal behavior as aggression or sexual abuseThis analysis shows the problematic delimitation between intimidatingsexual assaults and sexual abuse by prevalence, as well as the controversythat exists around the meaning of consent and how it should be granted,therefore, this work will focus on seeking those interpretative criteria thathelp us to make a fair application of the different criminal types.
