AB This research work aims to focus on the penal responsibility of the authorsor those responsible, in those scenarios where, always within the laborsphere, situations that damage the physical integrity of people aregenerated. In this way, it will deal with the obligations imposed the law byon the prevention of occupational risks, what the law tells us regarding thesubject matter, especially the Código Penal through its articles 316 and 317,who are the possible penal responsibles, with special attention to theemployer, and how has been interpreted by jurisprudence and what role theworker plays in the face of possible penal responsability of obligated thirdparties, given that they can generate scenarios that exempt entrepreneurs orsupposed responsables. All this based on works by authors specialized inthe field of Penal and Labor Law and ideas personally drawn from myinterpretation of them
