In the first place, its origin is studied, as well as itsapplication in the Spanish legal system, together with a detailed examination of each ofthe presuppositions and subprinciples that compose it. Secondly, the connectionbetween fundamental rights and its different theses are addressed, with specialreference to the proportionality of police detention.Likewise, it is delimited between proportionality in criminal procedural law and inmaterial criminal law, especially criminal proportionality. Finally, the work concludeswith a mention of the actions of the State Security Forces and Bodies and the applicationof the principles of proportionality, consistency and timeliness in their field of activity,both in relation to the measures they may adapt and the use of force employed.
