AB The object of study of this work focuses on the analysis of theinternational child abduction, were one of the progenitors moves or retainsthe child unlawfully in a state other than the habitual residence thusviolating the legal provisions.In order to achieve an immediate return of the minor, the states adoptequal procedures, as they are the 1980 Hague Convention and theRegulation 2201/2003, to achieve the immediate return of the minor. Butsometimes, there may be some reason for denial this return. The mostimportant thing in this case is the protection of the interest of the minor toprevent it from being violated.Although, as we know, despite the fact that these international texts arevery important, each State has a regulation for this, in the case of ourcountry is the civil prosecution law.
