AB This paper will deal with the transposition into Spanish law ofDirective (EU) 2019/1023 of the European Parliament and of the Council of20 June 2019 on preventive restructuring frameworks, on discharge of debtand disqualifications, and on measures to increase the efficiency ofprocedures concerning restructuring, insolvency and discharge of debt.More specifically, this paper will be focused on how its application willaffect refinancing agreements. To this end, the different options available in the legal text will betaken into account and it will be discussed which one is the mostappropriate to apply in Spain, given the need to reform the currentInsolvency Act. This is an opportunity to improve Spain's current system. In order toconfirm the certainty of this statement, its content will be analysed: from itsscope of application, both subjective and objective, to the discharge of debtprocedure, including the early warning tools, the stay of individualenforcement actions and the protection of interim finance tools, amongother aspects.
