AB The interception of telephone and telematic communications is aninvestigative measure that began to be used in criminal proceedings withlittle and deficient regulation, being complemented by the jurisprudence ofboth the Supreme Court and the Constitutional Court. This situation led thelegislator to carry out a modification of the Law of Criminal Procedure,through Organic Law 13/2015, of October 5, amending the Law ofCriminal Procedure for the strengthening of procedural guarantees and theregulation of technological investigation measures, which includes what isalready established by the jurisprudential doctrine.This research work aims to analyze the fundamental right affected,the secrecy of communications as well as all the budgets that, at present, arerequired for the interception of communications as an investigation,comparing it with the previous deficient regulation.Finally, it is analyzed how to introduce in the act of the oral trial theresults obtained with these proceedings so that they unfold evidentiaryeffects
