AB Once the Organic Act No. 5/2000 on the Criminal Responsibility of Minors enters intoforce, and following some reforms, some of the principles that inspired it havechanged, reflecting, for some doctrinal sectors, a more punitive character.To this end,we will try to analyse the reasons behind each of these reforms, highlighting the impacton society. In the face of the false belief that juvenile criminality is increasing, thethrust of these reforms has been to tighten up the procedural and criminal regimeapplicable to minors, perpetrators of an offence, imposing a severe punitive treatment,with the intention of dealing with increased criminal activity. We shall also examinehow this development has been reflected at present, with a detailed analysis of themeasures, both private and non-private of liberty, in juvenile criminal proceedings, aswell as the rules for their application, duration and enforcement.
