Eurest Colectividades, S.A. case.The court questioned the legality of a dismissal produced after the granting of sick leavedue to the illness of a worker. From then onwards, this concept has evolved in thejurisprudence of the European court, evidently influenced by the approval of the UNConvention on the Rights of Persons with Disabilities.Later on, in the HK Danmark case (in which the legality of the dismissal of variousworkers was questioned), the court adopted generally the concept of disability enshrined inArticle 1, 2nd paragraph of the aforementioned UN Convention. Additionally, the courtintroduced this concept in the analysis they usually carry out in order to solve legalconflicts related to the protection from discrimination in the workplace on the basis ofdisability.After an analysis of the European doctrine and jurisprudence on the matter, this paperconcludes that the concept of disability at the supranational level is subsumed under theconcept of professional incapacity when absorbed by the Spanish domestic legal order.These mismatches in the interpretation of transposed community laws by Spanish tribunalsproduced specifically in the area of incapacity and disability rights will be the subject ofthis research paper.The main consequence of the primacy of EU law over the Spanish domestic legal systemwith regards to deferred competences is that community norms need to be completely andadequately applied by the member state. However, the EU recognizes that there will bedifficulties when it comes to transposing said community laws and, moreover, applyingsuch laws administratively and judicially by the institutions in charge of closing the gapbetween transposed community laws and their application in the day-to- day of localcitizens.
