AB In this paper we address the study of the cases of atypicality in relation tothe crime of drug trafficking, included in article 368 CP, where there is alack of unanimity in both doctrine and jurisprudence regarding the legalityof these cases, alluding to a series of requirements or guidelines that mustbe carried out within each of them to be declared as atypical. This problemis linked to the lack of harmfulness and, therefore, all conduct that does notharm the protected legal right, which is public health, is left outside thescope of this article.Specifically, we will study self-consumption, shared consumption, the saleof insignificant quantities, the invitation or donation to a specific subjectand so-called compassionate deliveries. Special interest in the legality ofcannabis social clubs, as this is an issue of particular importance at present,starting from the basis on which the creation of these clubs is based, asituation that lacks state regulation.
