AB This paper addresses the current situation concerning the legal status ofunaccompanied foreign minors in Spain. The procedures to which they aresubjected from the moment they arrive on our shores will be dealt with, aswell as the difficulties they will have in being able to protect their rightsand interests on equal terms with other Spanish nationals. Therefore, it canbe said that this paper will be carried out based on two branches: anadministrative one and a judicial one.The exhaustive analysis of the first procedures to which they are subjectedwill be taken into account first, specifically the age determinationprocedure, which due to its current legal configuration violates multiplerights of the minor, including fundamental ones.And once we have studied the first branch, the one we qualify asadministrative, we will see the problems that these individuals have tosatisfy the right to effective judicial protection that is their own, since theywill have difficulties in being able to access the jurisdictional bodies indefense of their interests, remaining defenseless against the sameadministration that exercises their guardianship, and that in turn ignorestheir interests, causing, therefore, a conflict.
