AB A Public Administration and a private subject agree to a swap contract to satisfy their reciprocalinterests. While the private party complies with the stipulations from the first moment, thecounterpart - Public Administration, which has requested the drafting of this opinion - does notdo so. As a result, the private subject intends to reach an out-of-court agreement to satisfy hisinterests, and also to put an end to the controversy generated due to the breach of contract by thePublic Administration. Thus, the private subject seeks the resolution of the agreement, as well asthe restitution of the considerations to the previous state of such agreement, and thecompensation of the allaged damages, losses, expenses and interests. However, we will see howsome of these last issues would not proceed.
