AB Freedom of expression has been in our legal system since the beginning ofthe constitutional era, evolving until reaching the current regulation of thisright, enshrined as fundamental in Article 20 of the Spanish Constitution andsupported by the European Convention on Human Rights. This work is ananalysis of freedom of expression from the constitutional framework, as wellas from the European legal framework, where it is analyzed from theStrasbourg test, used as a method by the Court to prosecute restrictions onthe right in question, in addition to jurisprudence of this Court regardingfreedom of expression in European legislation. On the other hand, the limitsthat freedom of expression has at the national level are also exhaustivelyanalyzed when confronted with other fundamental rights, it’s digital frontierand freedom of the press as part of it, which includes an analysis of the WorldPress Freedom Ranking in 2021.
