AB In this paper we address the criminal response to gender violence, thisproblem acquires great relevance after the approval of LO 1/2004, ofDecember 28, on Comprehensive Protection Measures against GenderViolence, which motivates the reform of the Code Criminal and introducesspecific criminal measures. However, all figures of gender violencerequired the existence of an affective relationship for its application.Subsequently, LO 1/2015, of March 30, which modifies Organic Law10/1995, of November 23, of the Penal Code, provides a broader responseto gender violence by introducing gender without the requirement of theprevious existence of an affective relationship. Specific, gender isintroduced in the general part as one of the reasons for aggravatingdiscrimination in art. 22.4 CP, being able to apply this gender motivation inthe different criminal figures of the special part and also introduces othercrimes such as stalking, sexting, etc. in the special part, thus expanding thefield of application beyond the strictly affective.Specifically, we address the study of the crime of injuries of art. 148.4 CPand art. 153 CP, of the minor threats of art. 171.4 CP, of the slightconstraints of art. 172.2 CP, forced marriages of art. 172 (bis) CP,persecutory harassment or stalking of art. 172 (ter) CP, the slight injuries orvexations of art. 173.4 CP and the so-called sexting of art. 197.7 CP.Finally, we will also raise other practical problems in the application ofthese crimes, such as the requirement of domination or sexist element andthe possible violation of the non bis in idem, especially in relation to thegender aggravation and the mixed aggravation. of kinship in those cases. inwhich the circumstance is implicit in the specific criminal figure.
