AB The basis of our work is based on the preconstitution of evidence withregard to bodily interventions in the body of the accused, the object ofthis work being the alcoholometric methods conceived from the pointof view of preconstituted evidence and bodily intervention that theysuppose leading to carried out a detailed study of the corporalinterventions and of the pre-constitution of evidence in this regard aswell as an analysis of these methods from the point of view of theadministrative and criminal offense, which come to endow thedoctrinal ambiguity that exists about the conceptualization of theseevidence, which is carried out routinely by the judicial police, althoughwith express and sufficient regulation contained in the administrativelaw dimension, full of procedural formalities that must be compliedwith so that such diligence can be lawful and acquire probative valueone day, which makes it especially sensitive, also resulting in aquestion set of fundamental rights of the individual such as privacy,physical integrity or the right to defense, among others that has left nochoice to Spanish jurisprudence than to gradually pronounce itself,setting hermeneutical and sharp criteria
