AB As a consequence, from the expropriation activity by the Administration, a series ofguarantees arises for individuals, including reversion. A mechanism through whichindividuals, in order to counteract the inactivity of the Administration, are offered thepossibility of recovering property and rights of which they had been deprived due to the “causaexpropiandi” that founded the expropriation activity, and as a consequence of this inactivityhas disappeared. The problem comes from how retroactive application is understood and therights it may affect. In this sense, the “Tribunal Supremo” (Court Supreme) has been ruling,determining that, ultimately, we are not before an absolute right compared to otherfundamental rights, like the rest of the guarantees, but we are faced with a purely legal right.That is, this interpretation of the right of reversion confers the power to the public powers tomodify it in order to determine its content.
