AB This final work of final degree show a detailed analysis of the clauseresbus sic stantibus. This figure isn’t be regulated by Spanish civil code,for what it’s about a disposition of jurisprudential creation, require in thetribunals in front unexpected situations. The present monograph have theobject of plead for the possible codification of the clause rebus and hisapplication in view of the crisis occasioned by the COVID-19. For it, theyhave been used three investigation techniques: A law study ofcomparisonwith the rest of the European countries and a short mention tothe Latin-American countries, the inquiry approach of codification of thedisposition rebus sic stantibus propose in our country and a jurisprudentialanalysis about the application of the clause in our legal order. Analogouslyhave been making a historic inform of the pacta sunt servanda and therebus sic stantibus for more later, substantiate its complementation.
