AB This final thesis aims to carry out an analysis of the atypical contractual modalitiesprevailing in the business sphere, in view of the incidence of this in all areas of the life ofthe subjects, a consequence that the globalization has had in the legal field.We only intend to highlight the advantages of operating with this category of contract asa means of solving the problems generated by the use of factoring and engineering in thecommercial sphere.We list these advantages in view of the situation in which a heterogeneous, variable andcomplex service is involved, which has no specific prior regulation in the legal system,although this does not mean that it is not effective.And even more so, when it becomes clear that the classic normative provisions do notallow us to consider the set of legal relationships to be included in it, a consequence ofthe expansive effect of the contracts considered and classically considered, both by civildoctrine and by jurisprudence, under the name of atypical contracts.
