AB In this work, a new legal concept will be analyzed, to the point that it is not even regulated in ourlegal system, but has been judicially applied in certain cases. The experience of its application hasbeen remarkably positive, what has meant certain sectors has defended to popularize what is called"interim administrator", "silent administrator" or "trustee" among other meanings. The essentialnotion about the institution, revolves around on the dynamism, speed and flexibility that it suposeto the bankruptcy and pre-bankruptcy proceedings, avoiding the degradation and loss of value ofthe productives, personals and economics components that set up the company. To clarify theconcept we are dealing with and its goals, we will analyze similar concepts from other legalsystems that could be the “inspiration” or “starting point” of the Spanish case, as well as the saleof productives units as the context in which it concept of trustee takes place, or the statute of thetrustee or interim or silent administrator and its connotations. All these tools will allow us anaccurate approach to such a (still) unknown figure.
