AB This study aims to assess the impact that the Spanish 2020 COVID health crisis hashad on the Public Administration’s responsibility for damages caused to citizens’assets and rights as a consequence of the operation or performance of the publichealth services in that period.It establishes the constitutional precepts and relevant laws where we can find theregulatory development of the matter, as a reference to its legal regime. Also, therequirements are set out for claiming and entitlement to an indemnity.Once the general regime of health liability has been established in moments of legalnormality, the incidence of the coronavirus in health care activity is analyzed,highlighting the regulatory uncertainty that it causes, as well as the problems that itentails when it comes to filing health claims currently against the administration.
