AB In this work, the right included in article 24 of the Spanish Constitution of1978 called as effective judicial protection is studied. This right is withinthe catalog of fundamental rights and public freedoms of our Constitution,in short, it allows people to defend their rights and legitimate interestsbefore judges and courts, thus prohibiting defenselessness before them. Theprecedents of this right are analyzed, the mentions in other countries orlegislation at the international level, the right to effective judicial protectionis also mentioned as a fundamental right. It is article 24, with specialattention to its second section in which the guarantees that apply to theprocess are used, such as the right to free defense, the presumption ofinnocence and the right to use the means and resources that are establishedby law. Finally, some of the most relevant jurisprudence that mention thisright will be examined. In addition, article 24 gives rise to a purely laborlaw, the guarantee of indemnity which will be defined and also, a briefreference will be made to the procedural modality of protection offundamental right, and as with effective judicial protection, we will dealwith the most prominent jurisprudence of this right.
