AB The study that is presented is about rebus sic stantibus clause and itsapplication in hostelry and local lease. The Government decreed the state ofalarm due to the current pandemic. Therefore, we will discuss certain RoyalDecree-Law through which Government faced with this situation. It isnecessary to understand some basic information about these clauses, givingthe utmost priority to the pacta sunt servanda principle and consideringwhat force majeure constitutes in this kind of situation. What is more, thecase-law from the Supreme Court concerning the interpretation of theseclauses. Finally, we will consider the development of the Court´sjurisprudence from 1940 to nowadays. To sum up, I would like to outlinethe delicate situation in this kind of business due to temporary or permanentclosure of the business without generating revenue. This is the reason forthe rebus sic stantibus implementation to terminate or modify the contract.
