AB Technological advanes and the increase in crimes committed through theInternet have determined the need to introduce new figures. Among theserecently introduced crimes is the so-called sexting between adults that wasincorporated among the crimes against privacy in art. 197.7 penal code byOrganic Law 1/2015, of March 30, which modifies the Penal Code.In this work we will make a brief study of the evolution of this crime and ofthe most relevant aspects of this crime, such as the discussion on theprotected legal right; the scope of the typical action, the delimitation of thesubjects and the aggravated types, especially, sexting in gender violence,being very relevant, since in recent years, gender violence has increasedconsiderably, making it posible to carry out this crime over te internet.Likewise, we will address the bankruptcy problems of the crime, sincesexting can be accompanied by other crimes, such as blackmail, calledsextortion; humiliating and/or degrading treatment, and the crime of sextingin minors, which is closely related to the crime of child pornography.After an analysis of this doctrinal and jurisprudential crime, we willpropose some conlusions and proposals to give and adequate criminalresponse to this social conflicto.
