AB The concept of occupational accident, currently located in article 156 of theLGSS, has a background that goes back to the beginning of the 20th century.It represents a significant step in the legal system to promote the safeguardingof the well-being of workers and corporate responsibility derived fromcontingencies. Its evolution, however, has been very gradual and as a resultit presents deficiencies in writing that have made this mission more complex.The law has not come to connect completely with the reality of work, andtherefore many authors have not skimped when criticizing many of its terms.It is the task of this work to make a concise indication of those problems thatcurrently affect the quality of an aspect of such remarkable importance. Forthis, it will begin with a historical comment, followed by a separate study ofthe elements of the main concept and the complementary ones that havederived from the jurisprudential work. Finally, a brief review of the lack ofchanges that have taken place to face the new labor reality.
