AB In	this	work	we	will	analyze	the	 figure	of	the	National	Commission	of	Markets	and	Competition,	a	public	body	created	in	2013	that	is	framedwithin	 the	 independent	 administrative	 authorities	 regulated	 by	 Law	40/2015	 of	 the	 Legal	 Regime	 of	 the	 Public	 Sector, and	which	 has	 the	functions	 of	 guaranteeing,	 preserving	 and	 promoting	 the	 defense	 of	competition	in	Spain.	In	particular,	we	will	analyze the	role	of	this	body	in	mergers	and	acquisitions,	in	accordance	with	the	provisions	of	Law	3/2007	about the	Defense	of	Competition.	To	 do	 this,	in	 the	 first	 place,	a	 study	will	 be	 carried	 out	 on	 dissecting	the	 development	 of	 Competition	 Law	 in	 Spain,	 the applicable	regulations,	the	predecessor	bodies	of	the	CNMC	and	the	functions	that	it	 currently	 holds.	 On	 the	 other	 hand,	 the	 figure	 of	 business	concentrations	 and	 the	 role	 played	 by	 the	 CNMC	 in	 them	 will	 be	studied,	 with	 special	 emphasis	 on	 the	 administrative procedure	 of	prior	control	and	in	 specific	cases	 that	 the	CNMC	has	instructed	 from	2013	to	the	present.All	 this	 with	 the	 purpose	 of	 systematically	 exposing	 how	competitiveness	 is	 defended	 in	 business	 concentration	 procedures	through	prior control, how	this	control	affects	freedom	of	business	and	what	are	the	difficulties	encountered	by	the	CNMC	when	guaranteeing	effective	competition	in	all	markets	and	productive	sectors,	especially	taking	into	 account	 the	increase	in	 business	 concentrations	 that	 haveoccurred	 in	 recent	 times	 and	 the	 forecasts	 that	 many	 more	 will	 be	produced	in	the	future,	within	the	current	economic	context.
