AB Adoption is a legal instrument whose purpose is to protect those people, usuallyminors, who for certain circumstances are abandoned. However, this act has certaincharacteristics that, if not fulfilled, will transform the bond created into null orineffective, and although in principle the legislator has provided for the irrevocabilityof the adoption, this is not always the case. Throughout this work we will try to expose those most relevant causes for which it isoften impossible to constitute an adoption, or that being already constituted, it loses allvalidity. Although it is true that the legislator has made great efforts to preserve theeffects of adoption, these disappear or do not even arise if certain requirements aremissing. From the detailed analysis of the different reasons that display inefficiency to itsconsequences, in addition to the study of tort liability on the part of the Administrationwhen it is not possible to create the adoption due to its fault, we will try to explainlegally how they work. these dysfunctions.
