AB On March 14, 2020, the first state of alarm is declared by Royal Decree 463/2020 to dealwith COVID-19, but the restraint contained in article 7, which confines the entire Spanishpopulation with a list of exceptions of basic needs in which you can circulate on public roadsputs citizens on alert and begins a controversy marked by the distinction between limitationand suspension of fundamental rights, since it was mostly felt that it was a measure thatsuspended the right to free movement of article 19 of the Constitution and such suspensionwas only possible under the State of Emergency and not in the State of Alarm, where rightscan only be limited or restricted. This issue was resolved by the Constitutional Court in STC148/2021, of July 14, after an appeal of unconstitutionality presented by more than fiftyDeputies of the VOX Parliamentary Group.
