AB At the epicenter of Spanish Constitutional Law there are the FundamentalRights, which set the material and formal limits to public and privatepowers, and even to the legislative power.Among these, with regard to the evolution of individuals, and specificallyof the LGTBIQ+ Collective, the following stand out: the free developmentof personality, as the natural human capacity to act according to one's owncriteria, in order to develop the characteristics that differentiate one fromthe rest; equality, divided into equality in the law, referring to the obligationof the legislator to treat citizens uniformly, away from issuingdiscriminatory acts or rules, and in the application of the law, equaltreatment in the application of the rules; and finally, freedom of expression,understood as the expression of one's own ideas, without limitations, evenfrom the State.Over the years, these rights in relation to the Collective have evolved, bothlegislatively and jurisprudentially, and not only in our country, butthroughout the world, with cases of greater or lesser protection of the same,and even in Spain, depending on the Community, there will be a series ofrules or others, and we must analyse them to know where our countrystands, which, although it is in a high position in the Rainbow Europe, stillhas much room for improvement.
