AB The European arrest warrant is an instrument of judicial cooperationbetween the Member States of the European Union for the arrest andsurrender of persons suspected of having committed a criminal offence.This system represented a change in the body of European law, leavingbehind the extradition system that had been used in the European Union foryears.The novelty introduced by the EAW was mainly the principle of mutualrecognition of judicial decisions by the EU Member States, which directlyincorporated the judicial decisions of other states, as well as the exceptionto the principle of double criminality that had been used in the extraditionsystem. This exception is given by the recognition of a list of 32 offencesthat are exempt from dual criminality.The European arrest warrant came into force in 2004 and, since then, it hasbeen the instrument most widely used by the Member States to create thearea of freedom, justice and security that the EU had been seeking.
