AB Disability and its consequences have been the subject of different measures since the Romanlaw, passing from inducing a protection of the heritage of the disabled in the most archaicperiods, to motivating the protection not only of heritage, but also, the personal growth of thedisabled.This protection was the object of a modification substantially by the Law 8/2021, whichcompletely transformed the care system of the disabled, by introducing new features toreplace those already eliminated parental authority rehabilitated and prolonged power,prodigality and guardianship for adults. Among these innovations are, on the one hand, thevoluntary support measures, established as the axis of the new system; and, on the other hand,we find that the disabled person is the one who now makes the decisions with the supportprovided by him or herself or judicially.This notion of respect for the will, desires and preferences of the disabled person leads to thelegal figure of the notary, who will now be in charge of helping to create voluntary supportmeasures and adapting them to the legal system.
