AB The aim of this paper is to study the effect of the reform brought about by Law8/2021, of 2 June, on disability, and specifically its result in the field ofinheritance. To this end, we first proceed with a critical introduction to the law,followed by a brief commentary on the most significant advances in the field ofdisability prior to the reform, with an assessment of the Spanish Constitution andthe Convention on the Rights of Persons with Disabilities. Thirdly, it describeslegal capacity as a legal presupposition, and the new situation of capacity as aconcept. Fourthly, the different specific inheritance capacities are analysed, andhow they fit into the framework of capacity. It concludes with the importance ofthe notarial judgement, examining the figure of the notary, the evaluative actitself and how it fits into the public instrument.
