However, these measures affected ourfundamental rights and freedoms, rights that, in a the spanish State of Alarm, could onlybe seen limited and not suspended, and must respected the principles of proportionality,necessity and suitability, safeguarding the right to life and health of people, core rightsthat take precedence over any other, which is why it has been the subject of numerousdoctrinal and jurisprudential discussions.The Government of Spain, to adopt these measures, has had to declare the State of Alarmthree times through Royal Decree 463/2020 and Royal Decree 926/2020, applying to theentire national territory, and Royal Decree 900/2020 applicable exclusively to theAutonomous Community of Madrid. Likewise, the Government's Plan for the transitionto a new normality was analyzed, emphasizing the parameters that were necessary to beable to adapt our society to the new reality at a health, social and economic level.Finally, the way in which the Autonomous Communities face the end of the State of Alarmthrough Royal Decree-Law 8/2021, of May 4, is analyzed, adopting measures that requiredthe prior authorization or ratification of the corresponding Superior Courts of Justice (TSJ)of the respective Autonomous Communities.
