AB The aim of this study is to examine one of the causes of justification recognized inarticle 20 of the Criminal Code, which regulates the causes for exemption fromcriminal responsibility. It also analyses its treatments and application by the courtsand the way in which external and personal circumstances affect the application ornon-application of this figure. The cause of justification goes beyond what issimply stated in the Criminal Code, so that the analysis carried out by the differentcourts will not be enough with the simple application of art. 20, pp. 4 of the PenalCode. In order to be able to apply the defence, it will also be necessary to take intoaccount limitations not established in the legislation, but which are recognized byjurisprudence and a abroad sector of doctrine. The concurrence of the error in theuse of this figure will lead to the application of the same with some specialcharacteristics which are also emphasized in an attempt to gain a more in-depthknowledge of the so-called: "putative self-defence"
