When thebill of lading is transmitted to a third party who was not an original party tothe contract, the problematic question arises as to whether this clause isenforceable against the third party. In order to carry out the analysis of the aforementioned problematic issue,it is necessary to make a study of the rules, both at European level, Regulation1215/2015, and at national level, with the Maritime Navigation Act, inaddition to resorting to the jurisprudence ruled on the matter.
