AB The aim of this paper is to examine in depth the concept of disinheritancein Spain, analyzing its origin and basis, as well as the requirements that mustbe met for it to take place. The causes established by law for the testator tobe able to make use of this power are studied. Likewise, reference will bemade to the jurisprudential evolution of the Supreme Court in relation to theflexible interpretation of the legal cause of physical mistreatment; beingpossible, if certain conditions are met, to include psychological mistreatmentand family abandonment as a basis for the deprivation of the legitimate shareof children and descendants. Similarly, the legal regulation of the absence offamily relationship as a cause of disinheritance in the Civil Code of Cataluñawill be examined. Furthermore, mention will be made of the special situationin relation to disinheritance arising from the Covid-19 pandemic.
