AB The aim of this dissertation is to analyse in depth the crime of drugtrafficking contained in Article 368 of the Spanish Criminal Code.Through a study of this criminal offence and a subsequent comparisonwith the criminal legislation of neighbouring countries, I intend to raisethe possibility that cannabis, in a unique and specific way, should ceaseto be included among the substances prohibited by criminal law inSpain. To this end, I also comment not only on the main contributions ofthe doctrine, but also on an abundance of case law that shows that, astime goes by, the path of education can be more effective in protectingthe legal good of public health than all the existing prohibitions to date,which mean turning our backs on new social trends and, worse still, giverise to unhealthy behaviour that could really have a negative effect onwhat it is intended to protect: public health.
