AB The protection of safety and hygiene at work is configured as an obligation that the spanishconstitution imposes on public authorities, and also constitutes one of the guidingprinciples of social and economic policy.Criminal protection in this area is justified by the size of the assets affected and thegrowing level of occupational accidents. Thus, the legislator has configured articles 316and 317 of the Penal Code for this purpose.With respect to identifying the protected legal interest in these crimes, there are differentdoctrinal and jurisprudential opinions that will be analyzed. Also, the figure of the activesubject will be studied, with special reference to the delegation of functions. In addition,the self-endangerment of the worker and its impact on the criminal liability of the employerwill be analyzed.
